Earlier today The Bainbridge Law Firm shared the latest in its continuing series of Life Insurance Bulletins with its friends and colleagues. The latest installment discusses a summary judgment decision issued earlier this year in a class action lawsuit against a carrier arising out of the carrier's alleged arbitrary increases in cost of insurance charges. While a settlement was conditionally approved by the Court last month, the decision still serves as a warning to carriers about how they address future increases in cost of insurance charges on under-performing policies and provides a road map for navigating future litigation involving this issue.
